PHOTOGRAPHY AGREEMENT

BEFORE BOOKING WITH REED'S PHOTOGRAPHY, PLEASE TAKE A FEW MOMENTS TO LOOK OVER THIS AGREEMENT/CONTRACT

Please - No Cell Phone Photos During Mini Sessions.

RETAINERS:  The retainer is required at the time of reservations and is non refundable.  If the Client changes or cancels the engagement, the retainer will not be refunded.  If the Photographer fails to appear at the time and place agreed upon, then it shall be refunded to the Client.

CANCELLATION/POSTPONEMENT: Sessions are non-refundable, but retainers are transferable up to ONE YEAR if a date change is necessary (48 hours notice of postponements or cancellations is appreciated).  One transfer per retainer.  If sessions have to be rescheduled for any reason (weather etc) the retainer fees can be transferred to same session or any other session of choice and must be used within 1 year of original session date.  After 1 year - all retainers paid are non transferable or refundable for any reason.   

TURNAROUND TIME FOR GALLERIES:  I will have most sessions delivered within 2 weeks, depending on the seasons and the type of session.  I like to try to get them out by this time, but some seasons are extremely busy, and it may take a little longer.  But they are usually delivered within this time frame.  Proofing galleries will be delivered as soon as I begin that session.  These galleries are for you to choose the number of images you would like in your package, and once they have been chosen, I will begin editing them and have them delivered within the 2 weeks from your session date :)

PROPOSAL PHOTO SESSIONS - I make special accommodations for these sessions and they take priority over other sessions because it's such a big life event.  Preview will be sent the same day - proofing gallery will be delivered within 24 -48 hours unless I am out of town and unable to get to them.  I will discuss delivery times with you at the time of session. 

WEDDINGS turnaround time is much longer, obviously :) Those galleries take anywhere from 4-8 weeks, depending on length of wedding.  Preview will be given as soon as I get all the images chosen.

WEATHER: If sessions are canceled due to weather, Photographer and Client will reschedule at the earliest date possible, with no additional charge.  Retainers are refundable if PHOTOGRAPHER has to reschedule due to any circumstances.

COOPERATION/NO SHOWS:  Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions.  The Client shall assist and cooperate with the Photographer in obtaining the desired photographs, including but not limited to, specifying person(s) and or scenes to be photographed: taking time to pose for the photographs at the Photographer's direction, and with newborns and babies the Client shall provide assistance in posing if needed as well.  When doing milk baths or water sessions where the child will be sitting in water etc. the client is required to stay close to the child and help assist if needed. 

SESSIONS WITH LIVE ANIMALS:  All safety precautions are taken, and Reed's Photography will NOT be held responsible for any accidents caused by a live animal in the photo sessions.  The OWNERS of the live animals are also NOT held responsible for any accidents caused by live animals.  Clients assume responsibility for accidents that may occur on the property where photo sessions are taken.  Clients must assist their young children to handle the animals correctly to help ensure the session goes smoothly.  See also: Cooperation/No shows section above.  
Any sessions with live animals are NOT included in any giveaways. 

TRAVEL / HOTEL ACCOMODATIONS:  Travel fees and/or Hotel accommodations will be charged to the client for any sessions that require travel over 25 miles from Muldrow Oklahoma, or an overnight stay in a hotel.  Fees and details will be discussed prior to booking and agreed upon with the signing of this contract. 

LATE FEE:  All clients are asked to arrive at least 5 minutes early to their session.  A $45 late fee will be assessed if you are between 10-20 minutes late.  If you are more than 20 minutes late the session will be cancelled and is non refundable and non transferable. 

Failure to appear to your session without 48 hours notice will result in loss of Retainer fee.  I do allow your retainer fee to be moved to another future session if I have 48 hours notice.  If you need to cancel your session without any rescheduling that also results in loss of Retainer fee.  Retainer fees are non-refundable.   

COPYRIGHT: All images are copyrighted to, and remain the property of, Reed's Photography.  Print Releases will be given with the delivery of photographs.

CLIENT’S USAGE: Client is obtaining prints/images for personal use only.  Original, unedited photographs will NOT be given in addition to edited photographs.  If client wants lightly edited photographs the photographer must be informed ahead of time.  All photographs delivered are not to be altered with personal editing and / or filters and shared.  

**Do Not Screenshot images -- This takes away the quality of the photos and then does not represent my brand any longer.  Images with my logo on them are Copyright and are not to be altered or screenshot.  When you receive your images via proofing link, without the logo on them, then those are yours to download, save, share and/or print.  It is illegal to save or screenshot an image from social media with my logo and then have it printed, as these images are copyrighted. 

DIGITAL DOWNLOADS:  When you receive your gallery you have time to download your images to your computer.  Downloading to your phone, if your phone allows the big files, will diminish the quality of the photos.  For BEST results please download and backup your gallery to your computer and hard drive.  Your gallery has about a 2 month or so expiration date on it.  You will need to download your images to your own computer ASAP because after they expire they will be deleted from my website soon after. If your gallery has expired I can find and reload your images for you and send the link once more, there is a $20 fee for doing this.

I usually keep galleries about 48 months before deleting them permanently.  I only have so much room to store images.   Images in your gallery are too large for you to download to a phone. 

--ADDITIONAL IMAGES are available for purchase after choosing the ones you receive with your package.  

RAW / UNEDITED images will NOT be given or sold under any circumstances.
     

--PRICING for the extra images is $20 each, or if you want 5 or more I will discount them all 30%. This total must be paid in full for the images to be sent.  You can receive your package amount of images immediately and purchase additional ones at a later time if needed, but must be within 2 months or your gallery will be stored away onto my hard drive, where I will keep galleries for up to 2 years.  

If you have lost your gallery or failed to download images and need them reloaded and resent to you there will be a $20 gallery recovery fee.  

You may purchase a CD or Flash Drive with your images if you like for $20 each.  

Reed's Photography has the right to refuse service to anyone if the Photographer does not feel comfortable doing the suggested / requested photographs.

Reed's photography is not responsible for accidents.   

When we have live animals/pets or photo sessions that include water we take all safety precautions, and require you to be aware of this also.  Children must be supervised at all times and not allowed to leave the photo session location without parents.  During these sessions we insist the parents stay very near to the children.  

--Model Release  I hereby give permission to Reed's Photography to use my photos and likeness in all forms and media for advertising, portfolio, demo, trade, stock photography, editorial, altering without restrictions, and all other lawful purposes. I understand I am entitled to no compensation. I release the photographer of all forms of claims and liability related to my photo usage. I am over 18 years of age, and I fully understand the terms of this release.  (Boudoir sessions are not shared publicly, but some, with approval, would be shared in my private boudoir page. And this will be discussed with client beforehand.)
